CAREGIVER SERVICE AGREEMENT

This Agreement made between Canadian Caregivers Association (hereinafter "the CCA") and You (hereinafter "Applicant").

WHEREAS, the CCA is engaged in the business of forwarding applications to families for possible employment in Canada under the Live-In Caregiver Program; and

WHEREAS, the Applicant seeks his/her application to be submitted to families for possible employment in Canada under the Live-In Caregiver Program, under the terms and conditions hereinafter set forth:

1. The Applicant agrees to be included in the CCA database and the Applicant agrees his/her application and/or resume to be forwarded by the CCA to an unlimited number of families for possible employment in Canada under the Live-In Caregiver Program.

2. The CCA shall provide the following services:

a) storage and maintenance of the Applicant's electronic career record in the CCA database for a period of 12 (twelve) months or until the Applicant gets hired;

b) forwarding Applicant's documentation (application and/or resume) to families for possible employment in Canada under the Live-In Caregiver Program;

c) career profile updates at anytime during the 12 (twelve) months period or before the Applicant gets hired and/or resubmitting the updated documentation to families for possible employment in Canada under the Live-In Caregiver Program by Applicant's request.

3. Membership Fees paid to the CCA by the Applicant shall be non-refundable.

4. The CCA may change the fees at any time, in its sole discretion.

5. It is clear under the terms of this Agreement, that the Applicant enters into this Agreement individually and as a Supportive Member of the Canadian Caregivers Association, and that it is not the intention of the parties to create an employer-employee relationship between the parties herein; that the CCA acts solely in a service capacity; and that registration and the payment of Membership Fees herein above set forth do not guarantee that the Applicant will, in fact, be offered a position.

6. By entering into this agreement, the Applicant hereby waives any and all claims which may arise against the CCA for loss of life, personal injury, and/or loss of, or damage to any of the Applicant's property in connection with any employment the Applicant secures as a result of his/ her registration and the CCA service.

7. This Agreement may not be assigned by the Applicant.

8. In the event that any dispute arises between the parties concerning the terms of this Agreement, this Agreement shall be construed in accordance with the laws of the Province of Ontario, Canada.

9. In the event any provision of this Agreement is unenforceable or is in violation of the Province of Ontario public laws or any statute, the remaining provisions of this Agreement shall remain in full force and effect.

10. The Applicant agrees that the information contained in this Agreement and application is true, correct and complete to the best of his/her knowledge.

11. The CCA shall not be held liable and responsible in case of loss of Applicant's documentation (application and/or resume) due to technical or any other reason.

12. By submitting the online application to the CCA, the Applicant states that he/she has understood and agreed to the terms and conditions stated above.
